Website and Electronic Services Terms
Effective date: 4 October 2026
These terms govern the use of Caldermark-operated corporate websites and the electronic services made available through them, unless a specific product, platform, order or contract is governed by separate terms.
1. Service provider
The service provider is:
Caldermark Prosta Spolka Akcyjna ul. Sw. Filipa 23 lok. 3, 31-150 Krakow, Poland KRS 0001263631 NIP 6762726709 REGON 545582260 Share capital: PLN 10,000 Registration court: Sad Rejonowy dla Krakowa-Srodmiescia w Krakowie, XI Wydzial Gospodarczy Krajowego Rejestru Sadowego Email: info@caldermark.com
2. Scope
These terms apply to ordinary use of our websites and to free electronic functions offered through them, including where available:
- browsing website content;
- sending a contact, quotation, project or demo request;
- submitting an assessment or certification intake;
- downloading materials made available for that purpose;
- using an interactive demonstration or calculator;
- subscribing to an optional communication where a separate consent mechanism is provided.
Paid software, SaaS, certification engagements, engineering work, marketplaces and other commercial services may be governed by additional or separate contractual terms.
3. Technical requirements
To use the website, the user normally needs an internet connection, a current web browser and, for some functions, JavaScript and the ability to receive email. Users are responsible for the security and configuration of their own devices, networks and software.
We may use technical and security controls necessary to protect the website, forms and infrastructure from abuse, malware, automated attacks and unauthorised access.
4. Starting and ending electronic services
Browsing begins when the user opens the website and ends when the user leaves or closes the website.
A form-based service begins when the user voluntarily enters and submits information and ends when the request has been handled or the relevant interaction is otherwise closed.
Where an account-based product is offered, account creation, suspension and termination are governed by the product terms applicable to that service.
The user may stop using a free website service at any time by leaving the website or not submitting the relevant form.
5. Enquiries do not automatically create a contract
Submitting a contact form, intake, demo request, assessment request or quotation request does not by itself create a paid contract or oblige Caldermark to accept an engagement. A commercial contract is formed only through an applicable order confirmation, accepted proposal, signed agreement, online checkout or other clear acceptance mechanism.
6. User obligations
Users must not use the website or electronic services to:
- submit unlawful, malicious, deceptive or infringing content;
- attempt unauthorised access to systems, accounts, source code, data or infrastructure;
- interfere with availability, security or performance;
- distribute malware, exploit code, spam or abusive automated traffic;
- impersonate another person or falsely claim authority to act for an organisation;
- upload material they are not authorised to provide;
- use demonstrations, documentation or website content to violate applicable law or third-party rights.
Security research or testing against Caldermark systems is permitted only with prior written authorisation or under a published vulnerability-disclosure policy that expressly permits the relevant activity.
7. Intellectual property
Unless otherwise stated, website content, software interfaces, designs, text, graphics, brand elements, documentation and demonstrations are owned by Caldermark or its licensors and are protected by applicable intellectual-property laws.
Users may view and use public website content for legitimate informational and business-evaluation purposes. No ownership, source-code right, resale right, sublicence or right to create a competing derivative product is granted merely by accessing a website or demo.
8. Demonstrations and illustrative information
Interactive demos, simulations, calculators, sample dashboards and example outputs are provided to illustrate product concepts or capabilities. Unless expressly identified as customer production data or a contractual performance result, demonstration values should be treated as illustrative.
Product features may evolve. A public demo does not create a warranty that every feature shown will be included in a future customer implementation unless it is expressly included in the agreed scope.
9. Website information
We aim to keep website information accurate and current, but general website content is not a substitute for a signed scope, technical specification, legal opinion, tax advice, professional certification decision or other formal engagement where one is required.
Quotations, availability, timelines, certification routes and technical requirements may depend on the specific project and are binding only where confirmed in the relevant commercial documentation.
10. Availability and maintenance
We may update, suspend, restrict or discontinue parts of a website for maintenance, security, operational or product reasons. We do not promise uninterrupted availability of free public website functions.
11. External links
Links to third-party websites are provided for convenience or reference. Caldermark does not control those websites and is not responsible for their content, availability or independent privacy practices.
12. Complaints concerning electronic services
A complaint concerning the operation of a Caldermark website or free electronic service may be sent to info@caldermark.com.
The message should, where possible, identify the relevant website or service, describe the issue and provide contact details needed to respond. We will review complaints without undue delay and may request additional technical information where necessary to investigate the problem.
13. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded or limited.
To the extent permitted by law, Caldermark is not responsible for losses caused solely by the user's unlawful conduct, failure to secure their own environment, unsupported browser/device configuration, third-party services outside Caldermark's control, or reliance on clearly illustrative or non-binding website material as if it were a contractual commitment.
Different liability rules may apply under a signed customer agreement, product terms or mandatory consumer law.
14. Privacy and cookies
Personal data is handled as described in the applicable Privacy Policy. Browser storage and tracking technologies are governed by the applicable Cookie Policy and Cookie Settings.
15. Governing law
These terms are governed by Polish law, without limiting mandatory rights that apply under the law of a user's place of residence where such rights cannot be excluded.
For business-to-business disputes, unless another agreement provides otherwise, the competent courts in Poland may have jurisdiction in accordance with applicable procedural law.
16. Changes
We may update these terms when our websites, services or legal requirements change. The version published on the relevant website applies from its stated effective date.
